Theological Oversight & Jurisprudential Integrity

Shariah Advisory Board Charter & Fatwa Protocol

Governance Framework for Islamic Matrimonial Compliance • Grounded in Quran, Sunnah, and Classical Madhahib

1

Mandate & Theological Mission

NikahContract.ai is engineered as a scribal instrument (Katib) and procedural matrimonial workflow system designed in strict compliance with the Quran, Sunnah, and classical jurisprudence across the recognized schools (Madhahib).

The platform provides computational mediation and liturgical assistance based on classical legal texts and OIC Fiqh Academy standards. NikahContract.ai is not an independent issuing Fatwa council; couples and families are strongly encouraged to invite their local Imam or scholar to supervise and endorse their contract through the Imam Co-Pilot portal.

2

Council Composition & Madhab Representation

Hanafi Jurisprudence Oversight

Supervision of adult female contractual agency, non-financial marital stipulations, and detailed Mahr allocation standards.

Shafi'i & Maliki Oversight

Supervision of guardian (Wali) authorization protocols, lineage order verification, and strict witness auditing.

Hanbali & Premarital Rights

Oversight of contemporary premarital covenants, delegated divorce rights (Tafwid al-Talaq), and education/career safeguards.

Telecommunications & Remote Contracting

Adherence to OIC Islamic Fiqh Academy Resolution No. 52/6/6 concerning contracting via modern telecommunication and video synchronization.

Core Theological Principles Codified in Code

  • Human Agency as Sole Validating Source: The software and AI models act solely as instruments (Wasail) and scribes (Katib). The actual sacred bond is formed strictly between the human bride, groom, wali, and witnesses.
  • Synchronized Session (Ittihad al-Majlis): The platform enforces sub-100ms real-time WebRTC audio/video sync to ensure that the offer (Ijab) and acceptance (Qubul) take place in a continuous, uninterrupted session.
  • Witness Integrity (Shuhud): At least two sane adult Muslim witnesses must actively observe the consent exchange and sign the tamper-proof cryptographic record.
  • Preservation of Dowry (Mahr): A specified immediate and/or deferred Mahr is mandatory for contract validity, preventing ambiguous or coercive terms.

Imam & Mosque Institutional Co-Pilot

Local Imams and Islamic Centers can supervise, customize pastoral sermon notes, and digitally endorse ceremonies through the Imam Co-Pilot Portal.

Endorsed ceremonies receive a certified institutional seal on both the public cryptographic verification ledger and the physical 24k gold-foil keepsake.
