Master Terms of Service & User Agreement

Acceptance of Terms & Core Purpose

By accessing, browsing, or using the services provided by NikahContract.ai, Inc. ("NikahContract.ai," "we," "our," or "the Platform"), you ("User," "Couple," "Guardian/Wali," or "Witness") agree to be legally bound by these Master Terms of Service.

NikahContract.ai provides a software-facilitated environment for bilateral Islamic marriage contract (Nikah Nama) alignment, liturgical ceremony recitation, synchronized remote multi-party video streaming, and physical keepsake fulfillment.

Theological Nature & Religious Solemnization Disclaimer

2.1 Role of Artificial Intelligence as Scribe and Liturgist (Katib)

Non-Personhood: Users acknowledge and affirm that the AI Officiant operates strictly as an automated liturgical reciter, interactive scribe (Katib), and procedural facilitator. The AI does not possess spiritual personhood, apostolic authority, or judicial authority (Qadi).

Source of Sacred Validity: The theological validity of the Nikah derives exclusively from the conscious, voluntary, and uncoerced human consent of the Bride and Groom (Ijab & Qubul), the authorization of the Guardian (Wali, where required by the applicable Madhab), the presence and confirmation of at least two sane adult Muslim witnesses (Shuhud), and the mutually agreed Mahr (dowry).

2.2 Madhab Selection & Theological Autonomy

The Platform provides configuration rule sets for the Hanafi, Shafi'i, Maliki, and Hanbali schools of Sunni Islamic jurisprudence, as well as the Ja'fari school. Couples are solely responsible for selecting the school of thought matching their personal convictions and familial commitments.

Civil Legal Marriage vs. Religious Rite

3.1 Separate Legal Spheres

Tier 1 (Essential Ritual) and Tier 2 (Keepsake Signature): These tiers provide exclusively religious solemnization and private contract memorialization. They do NOT automatically constitute a civilly recognized marriage in secular jurisdictions (including but not limited to the United States, the United Kingdom, Canada, Australia, and European Union member states).

Civil Registration Requirement: In most Western jurisdictions, couples must independently obtain a Marriage License from their local municipal, county, or state clerk and have it signed by a state-licensed officiant to obtain civil legal recognition.

3.2 Tier 3 (Civil & Sacred Bundle)

For couples purchasing Tier 3, NikahContract.ai provides a guided digital pipeline under Utah Code § 30-1-6, connecting users to independent ordained/licensed officiants physically located in Utah who perform remote two-way video solemnization. NikahContract.ai is a technology platform and not a law firm.

Contract Mediation, Mahr, and Prenuptial Stipulations

No Legal Advice: The "Intelligent Mediator" facilitates private discussion and mutual consensus regarding Mahr (Immediate and Deferred) and contractual clauses (Shurut). This does not constitute legal counsel under secular prenuptial agreement statutes.

Enforceability: The civil enforceability of religious marriage contracts and deferred Mahr claims varies across state and national jurisdictions. Users wishing to maximize civil enforceability of financial clauses are advised to execute a separate civil prenuptial agreement with qualified independent legal counsel.

Witness Verification & Biometric Consent

All parties executing digital signatures on the Platform warrant and represent that they are of sound mind, legal age of majority in their jurisdiction, and acting free of duress or coercion.

The Platform records cryptographic timestamps, IP addresses, and vocal consent affirmations to preserve an evidentiary audit trail for the couple's private archival vault.

Physical Keepsakes & Refund Policy

Physical keepsakes (24k gold-foil framed parchments) are custom manufactured upon ceremony completion and verified signature execution.

Custom-printed goods are non-refundable once printing and hot-foil stamping has commenced, except in cases of manufacturing defect or shipping transit damage, in which case NikahContract.ai provides a 100% complimentary replacement.

Governing Law & Faith-Based Dispute Resolution (Tahkeem)

Secular Jurisdiction: These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.

Faith-Based Arbitration (Tahkeem): In the event of any personal or marital interpretation dispute arising under the religious clauses of the Nikah Nama, the parties agree to first submit the matter to mutually agreed Islamic arbitration (Tahkeem) or a qualified Islamic judicial council before initiating secular court litigation.
